Referrers play a crucial role in informing clients about mediation. Proper referral helps clients make an informed choice and access a mediator faster. The Federal Mediation Commission (FMC) provides guidelines to support the provision of accurate information.

What information should be included?

To guide clients well, it is important to give them the following:

  • A clear explanation of mediation: how it works, what the benefits are and what steps are required.
  • Practical information on the role of the mediator, confidentiality of talks and the option of having the agreement approved by a judge.
  • A list of accredited mediators.
  • Brochures and documentation that can help clients prepare for mediation discussions..

Roadmap: how to refer someone to mediation?

This roadmap can be an initial plan of action:

  1. Gauge willingness. Briefly explain what mediation entails and ask if both parties are open to this approach.
  2. Provide information neutrally. Refer to official information and brochures from the FMC.
  3. Help choose an accredited mediator with the appropriate expertise. Use the database of accredited mediators, possibly filtered by specialisation and region.
  4. Provide practical information. Contact details, anticipated costs (including pro bono opportunities) and first steps.
  5. If necessary, follow up. Check if contact has been made and if additional support is needed.
