The Disciplinary and Complaints Commission (also known as the "Disciplinary Commission") is one of the three standing commissions of the Federal Mediation Commission. It oversees the professional ethics of accredited mediators, handles complaints against mediators and mediation training institutions, and provides advice on preliminary questions arising from disputes over mediators’ fees.
Composition of the Disciplinary Commission
The Disciplinary Commission is composed of five members: a chair, four active assessors, and two deputy assessors. Four deputy assessors are also appointed. The vice-chair assumes the chair's duties when the chair is absent or unable to attend. With the exception of the chair, the commission has an equal number of Dutch-speaking and French-speaking members. The assessors are appointed for a term of three years. What are the powers of the Disciplinary and Complaints Commission?
The commission is authorised to hear complaints against accredited mediators. Based on Article 1727/5 of the Judicial Code, it can impose sanctions for violations of the code of professional ethics. However, the commission cannot annul conciliation agreements or impose remedial measures arising from the annulment of an agreement (Case 2023/NL/004).
Possible penalties for infringements:
- reprimand or warning;
- temporary suspension of mediator accreditation;
- permanent removal from the list of accredited mediators.
